TERMS & CONDITIONS

When you register to attend the Walcha Motorcycle Rally (WMR) you acknowledge that you have read, understood and agree to these Terms.

Definitions

In the Terms ‘we’, ‘us’, ‘our’ and ‘the organisers’ mean Walcha Council and ‘you’ and ‘your’ refers to persons who register and attend the Walcha Motorcycle Rally.

CAMPING at SHOWGROUND

  • If you intend to camp onsite at the Showground, you are required to pay a site fee. This fee is an ADD ON to the ticketing page. Passes, Merchandise Packs and Camping can all be paid for in one transaction.
  • FLAT RATE $30pp | includes up to 3 Nights | Thursday – Sunday
  • Access to Amenities & Showers

  • Wristband | People staying onsite at the Showground will be required to wear a Camping wristband
  • By choosing to camp at the Walcha Showground you acknowledge liability and responsibility for your own belongings (including personal effects, bikes, vehicles etc) at the site.
  • You also acknowledge responsibility for your own actions whilst in this public area, and any unlawful, offensive or unruly behaviour may result in you being removed from the grounds or Police involvement.

ORGANISED RIDES

GUIDED ROAD RIDES

  • Walcha Motorcycle Rally Guided Road Rides are only available to RALLY PASS or FRIDAY – DAY PASS holders.
  • Guided Road Rides are being offered on FRIDAY ONLY
  • Guided Road Rides are only available to those who pre-register (see ticketing page to register)
  • There are limited rider numbers for each ride (50)
  • Event Organisers will be in contact with registered riders prior to the day with further details
  • Guided Road Rides are on offer  – details will be announced closer to the event.
  • Each rider accepts the inherent risks involved in this type of guided road rides and participates at their own discretion. Walcha Council, event organisers and volunteers accept no liability or responsibility for any incident or accident that may be incurred during these rides

ON THE DAY

  • Meet at Showground at specified time
  • Show proof of RALLY PASS or DAY PASS purchase (Wristband)
  • Having pre-registered online, sign-in with Event Organisers

SUPPORTED ADVENTURE RIDES

  • Walcha Motorcycle Rally Supported Adventure Rides are only available to RALLY PASS or DAY PASS holders.
  • Supported Adventure Rides are available for registration on both FRIDAY & SATURDAY
  • Supported Adventure Rides are only available to those who pre-register (see ticketing page to register)
  • There are limited rider numbers for each ride (50)
  • Event Organisers will be in contact with registered riders prior to the day with further details
  • Supported Adventure Rides are on offer – details will be announced closer to the event.
  • Each rider accepts the inherent risks involved in this type of guided adventure rides and participates at their own discretion. Walcha Council, event organisers and volunteers accept no liability or responsibility for any incident or accident that may be incurred during these rides.

ON THE DAY

  • Meet at Showground at specified time
  • Show proof of RALLY PASS or DAY PASS purchase (Wristband)
  • Having pre-registered online, sign-in with Event Organisers
  • Support Vehicle on hand should the need arise
  • Rides are graded according to skill level i.e. 1 (Easy) to 5 (Hard)

Payment for Registration and Confirmation of Purchase

  • Payment will be made online through the Floktu link on the WMR website.  No credit card details entered during the registration process are held by Walcha Council.
  • A confirmation email will be sent by Floktu to you through the email address you provide when registering for the event.

WRISTBAND

A WMR wristband matching your ticket type, ie. Rally Pass, Day Pass – Friday, Day Pass – Saturday will be given to you on arrival at the Walcha Showground. Each of these wristbands will be colour-coded to identify eligibility for event entry on specified day.  You will need to show your ID and booking confirmation to receive your wristband.  Your wristband allows you entry to the showground.
An additional wristband will be distributed to those who are staying at the Showground.  DIY Campers must have purchased the Camping at Showground site fee (an add-on in the ticketing items).

Wristbands are non-refundable and non-transferrable and must be worn for the duration of the WMR.

Children aged 16 years and under are admitted free in the company of a supervising, paying adult.  These children will be issued with a wristband which must be worn at all times.  The accompanying adult is responsible for the minor’s behaviour and safety, ensuring they are supervised at all times.

INDEMNITY

You choose to come to the WMR at your own risk and to the full extent permitted by law, you release and indemnify the organisers, its agents, employees and volunteers from and against any claim or liability of any nature in relation to injury or death, from you or any third party which might arise from entry to or the use of the rally site by you and any accompanying person and or minors regardless of how the damage, injury or death is sustained or caused.

You indemnify Walcha Council and its employees and volunteers against any and all liabilities, claims and actions that may eventuate from your attendance at or involve in the WMR.

The organisers are not responsible for any accidents. It is agreed and understood that the organisers are not the guardians of any customer safety and that they, individually or collectively, can not be held liable in any way for any occurrence in connection with the WMR which might result in injury, death or other damages to the customer or their property.

GENERAL CONDITIONS

For the comfort, safety and enjoyment of all persons, Walcha Council advises that:

  • Persons gaining unauthorised access to Walcha Showground and/or any of Walcha Motorcycle Rally’s specific areas may be liable for prosecution.
  • Persons enter Walcha Showground at their own risk and must take proper care of all things they bring onto Walcha Showgrounds. Walcha Council is not liable for any loss or damage to personal property.
  • Persons entering Walcha Showground agree to be responsible for their own actions and indemnify Walcha Council against any loss or liability, cost, expense, or damages arising from or in relation to their acts or omissions.
  • Persons entering Walcha Showground acknowledge that some activities are dangerous. Persons viewing such activities do so at their own risk.
  • Walcha Council reserves the right to inspect and search bags, motorbikes or vehicles brought into or out of Walcha Showground and search all persons, their clothing and other items of such persons.
  • Persons causing a disturbance or refusing to comply with requests from Walcha Council will be ejected from Walcha Showground.
  • Walcha Council may eject person from Walcha Showground for unauthorised sales or hawking of goods and services.
  • Walcha Council may refuse admission to or eject persons from Walcha Showground at its sole discretion.
  • Persons entering Walcha Showground must adhere to the Work Health & Safety legislation and in particular the Walcha Council Work Health and Safety Policy.
  • Smoking (including electrical cigarettes, personal vapourisers, electronic nicotine delivery systems or any other battery powered vapourisers) is prohibited indoors and at all catering, public seating, or spectating areas of Walcha Showground.
  • Any wristband purchased to enable entry into Walcha Showground or any area or event at Walcha Motorcycle Rally cannot be exchanged or returned after purchase.
  • A person by entering Walcha Showground consents to Walcha Council or third parties appointed by Walcha Council photographing, filming, or taping. Walcha Council or third parties appointed by Walcha Council can broadcast, publish, licence and use any photographs, film, recordings, or images without compensation. Walcha Council, third parties and anyone acquiring from them a right to use the material are not liable to the subject for its use in any way.
  • Entry to Walcha Showground does not guarantee automatic entry to designated camping areas during the period of entry. A specific wristband will be given to campers.
  • Motorcycle and vehicle access to Walcha Showground is restricted to designated vehicle routes and parking areas. Vehicles must not block emergency egress doors or emergency vehicle access roads and are to give way to emergency vehicles.
  • The WMR will not be cancelled due to adverse weather except on the advice of emergency services in extreme conditions.
  • We may cancel the WMR, or a component of the WMR due to unforeseen reasons. In such case, the WMR or a component of the WMR may be rescheduled or something put in it’s place.  If the WMR or a component of the WMR to which the Purchase Item relates is cancelled, you have the right to obtain a refund of legitimately purchased Purchase Items but may need to apply for a refund or otherwise follow our reasonable refund process.  We may charge a reasonable fee in the event of a refund.
  • The organisers reserve the right to vary advertised performing artists, entertainment and the WMR program as is required and at its absolute discretion. We do not accept any liability for loss or inconvenience caused by such cancellations or changes. You must comply with applicable health and safety laws, report all accident or emergencies or other incidents to us or to the organisers and follow all safety and security related directions and venue specific rules.
  • You must comply with all rules, signs and notices at the venue and follow any reasonable directions given by us.
  • In the event of not complying with the terms and conditions, you acknowledge that Walcha Council reserves the right to take immediate action to seek compliance with the conditions of or that you may be asked to vacate the WMR event site by Walcha Council.
  • You may be photographed or filmed and you consent to images and footage being used in promotional material for Walcha and the event.
  • The venue may at their sole discretion: a) reserve all rights to change the advertised program or access to certain areas: b) may search you, confiscate items, refuse admission or eject you; c) may refuse entry for damaged or defaced wristbands.
  • You may only purchase WMR Rally Pass or Day Pass as a non-commercial consumer for your non-commercial, personal use. You must not purchase or use your registration and wristband in a commercial capacity in any way (including but not limited to offering the registration and wristband as prizes/gifts in consumer promotion/raffle/competition) without obtaining prior written consent from Walcha Council. If this occurs, you or subsequent ticket holder may be refused entry and the event registration and wristband cancelled.

LICENCED AREA

Persons seeking entry to Walcha Showgrounds are advised that:

  • They are entering a licensed area.
  • Intoxicated persons will not be permitted to enter.
  • Intoxicated persons will be removed from Walcha Showgrounds.
  • It is an offence for minors to purchase or consume alcohol.
  • It is an offence to sell to or supply minors with alcohol.
  • Persons supplying alcohol to minors will be reported to police.
  • Penalties apply under the Liquor Act 2007.

REFUND POLICY

Cancellations:-

  • prior to August 19 2024 will obtain a full refund, minus any booking fee.
  • with written notice between August 19 2024 to October 19 2024, will receive a 50% refund.
  • made from 19 October 2024 will not be refunded. However, if you would still like your Merch Pack this can be mailed to your Australian address for a postage fee of $15 per parcel after the event.

There is no refund if you fail to attend the WMR, however, if requested, your Rally Pack will be mailed to your Australian address for a postage fee of $15 per parcel after the event.

COVID-19

Walcha Council is committed to reducing the spread of COVID 19 in the community. In response to the ongoing COVID-19 pandemic and in accordance with NSW Health requirements persons entering the Walcha Showground MUST NOT have COVID 19 or be unwell.

Participants, visitors and attendees to the event should:

  • Maintain a physical distance
  • Practice good hand hygiene
  • Comply with any current NSW Health order requirements as they arise

Persons entering acknowledge that even with control measures in place there remains a risk of transmission of viral illness including COVID-19. NOTE: Any variation to the policy from time to time will be at the sole discretion of Walcha Council.

If you are unable to attend due to conditions listed in the above-mentioned clause, a refund request can be submitted to tourism@walcha.nsw.gov.au

PHOTOGRAPHY

It is not intended for amateur photographers to be restricted from taking photos around Walcha Showground and at Walcha Motorcycle Rally related activities providing that:

  • the photographer is not causing annoyance or inconvenience to other patrons.
  • that the subject of the photo is not one detailed in the Summary Offences Act 1988 (NSW).
  • the subjects have given their consent (if under 18 then their parents’ consent); and
  • the photos are not to be sold for commercial gain.

BEHAVIOUR

  • Possession, sale or use of illicit substances is strictly prohibited at the rally and on site. Any person found with illegal drugs or illicit substances in their possession or participating in illegal activities will be removed from the site and subject to Police action.
  • The organisers may refuse you entry into or remove you from the Rally if you do not obey the WMR terms and conditions, interfere with the enjoyment, comfort or safety of other persons at the WMR or disrupt the WMR in any way.
  • If you are evicted from the WMR or denied entry you will not be entitled to any refund or compensation.
  • Patrons must not cause damage to, improperly use, or tamper with any site facility or event infrastructure.
    All riders are bound to and subject to the laws and regulations as set out by Roads & Maritime Services NSW and NSW Police Force.

GENERAL

Patrons accept full liability and responsibility for any loss or damage caused in contravention of any term of these Terms and Conditions.
